Apple's Crystal Prison and the Future of Open

Two weeks ago, Steve Wozniak made a public call for Apple to open its
platforms for those who wish to tinker, tweak and innovate with their
internals. Wozniak is right. While Apple's products have many virtues, they
are marred by an ugly set of restrictions on what users and programmers can
do with them. Apple's recent products, especially their mobile iOS devices,
are like beautiful crystal prisons, with a wide range of restrictions
imposed by the OS, the hardware, and Apple's contracts with carriers as
well as contracts with developers.
TV Networks Say You're Breaking The Law When You Skip

Television networks are having a busy month trying to stamp out new
TV-watching technology. EFF and Public Knowledge have filed an amicus brief
supporting Aereo, a New York startup under fire from the networks for
bringing local broadcast TV to the Internet. And now the same networks have
told a court that skipping a commercial while watching a recorded show is
illegal, suing Dish Network over its digital video recorder with automatic
commercial-skipping.

Reality TV Star's Lawsuit Flouts Laws Protecting Internet

EFF has asked a judge today to block a reality TV star's attempts to censor
critical comments about her company on a popular online fashion blog. Corri
McFadden, star of the VH1 show "House of Consignment," filed suit against
Purseblog.com in a California federal court after accusations about
McFadden's company, eDrop-Off appeared in the comments of the blog. But
California has strong legal protections against lawsuits filed to chill
participation in publicly significant discussions, and now McFadden is
asking the court in California to let her dismiss the lawsuit without any
penalty so that she can pursue it in a state with more favorable law.
Megaupload User Asks Court for Files Back.

EFF's client, Kyle Goodwin, asked the court to return the legal files he
lost when Megaupload was seized last January. Since then, we've been to
court, both for a hearing and a mediation, and nothing has changed. The
government has failed to help third parties like Kyle get access to their
data, so we have no choice but to go back to court.
Google Releases New Copyright Transparency

Google has expanded its transparency reports program by releasing a
detailed report of content removal requests from copyright holders. The new
copyright report joins its semi-annual government takedown transparency
report, and covers more than 95% of the copyright takedown requests it has
received for Search results since July 2011. We hope this is just the
beginning: Google should extend the program to their other properties like
YouTube and Blogger, and other online service providers should follow suit.
Supreme Court to Federal Circuit: Fix Ultramerical

The Supreme Court said in Mayo v. Prometheus that there could be no valid
patent from adding nothing novel to an otherwise unpatentable idea. At the
time, we commented that this ruling should likewise apply to software
patents, so that merely adding a "conventional step" to an otherwise
abstract idea would not make that abstract idea patentable -- which is
exactly what happened in the Ultramercial v. Hulu case. The Supreme Court
has now told the Federal Circuit to reconsider its Ultramerical ruling in
light of Mayo, which sounds a lot like an endorsement that Mayo's
limitations on patentable subject matter should extend to software, too.
Sorry We're Not Sorry: Interview with Lino Bocchini of Falha de S.

Lino and Mario Bocchini, creators of the Brazilian parody website Falha de
Sao Paulo, are currently appealing a court order that froze their domain
two years ago. In September 2010, Brazilian newspaper Folha de Sao Paulo
filed a lawsuit against the Falha seeking financial compensation for
mimicking their layout and copy-editing, and also for "moral damages" to
its reputation as a news organization. While the financial indemnities were
dropped, Falha's domain remains frozen for unauthorized use of Folha's
intellectual property.

protected insurance company profits by making it harder for states to act.

cutting private insurance companies and their profits and bureaucracy out

Wisconsin is ground zero in the fight to save the American Dream. In less
than two weeks, Wisconsin voters will decide whether to recall the infamous
Governor Scott Walker. Everyday people are taking a bold stand against
those who would sell our democracy to the highest bidder, wrecking the
economy while giving away huge tax cuts to the ultra-wealthy. What happens
in Wisconsin affects all Americans.
This past Saturday in Milwaukee, we organized Rebuild Wisconsin to
supercharge get-out-the-vote efforts for the recall election. More than a
thousand people came out for a day of political action infused with culture
and art. (See below for highlights.)
We're proud of what happened last Saturday, but what happens next is what
really matters.
Our partners in Wisconsin tell us that victory is within reach, but this
people-powered campaign needs even more people. They are setting up a
"virtual phone bank" so anyone across the country can volunteer.* No matter

A lot of people told us that an event like this -- a multi-racial event
fusing politics and culture -- had never happened before in Milwaukee.
In an election this close, low-income voters and communities of color in
Milwaukee could be the deciding factor. That's why we hosted a local talent
showcase that brought out Milwaukee's up-and-coming hip-hop artists -- as
well the networks of hundreds of young people who listen to them. Our event
inspired young people who otherwise may not have engaged in the recall
election or in the broader political movement.
Congresswoman Gwen Moore and our very own Van Jones were keynote speakers.
Indie-soul-songstress and native Milwaukeean Grace Weber gave an amazing
performance that left no doubt she is a rising national star. Renowned
hip-hop artist and activist Jasiri X debuted "You're Fired," a song
dedicated to Scott Walker that is an anthem for the whole recall election.
This event was more than just a concert and rally -- it was part of a major
GOTV operation. Everyone there plugged their information into the statewide
GOTV database and also named 5 people who they would personally turn out
for the election.
We were honored to partner with some amazing organizations, including: The
League of Pissed Off Voters, Wisconsin Jobs Now, SEIU, We Are Wisconsin, We
Are Milwaukee, and Citizen Action of Wisconsin.
Thank you for joining us -- together, we added a big shot of momentum to

We who want Walsh out, and Roskam, along with those of us who stand against the Ryan budget, will be there.

fundraising luncheon at the Westin Hotel on Monday, May 21st at 11:30 am.

*After all the preparations, trainings and volunteer recruitment, Chicago
will be in the world spotlight as it hosts the NATO summit this
weekend. *Thousands
from across the nation – and around the globe – are expected to exercise
their freedom to assemble peacefully and express themselves during the
summit.
The ACLU of Illinois has developed a wide variety of resources to help
ensure freedom of speech and assembly. First, and most visibly, we are
deploying trained observers at many of the rallies and marches to deter,
and record, potential violations of civil liberties by the police and other
authorities.
We also are working hard to ensure that demonstrators are aware of all
their rights under the First Amendment, and how to protest safely and
legally in the City of Chicago. We've produced an extensive report on the
right to protest in

and set up a mobile website

If you believe its marketing hype, you'd think Chipotle does everything it
can to source its ingredients ethically. But you just have to unwrap the
burrito a little bit to realize *the way Chipotle purchases the tomatoes
for its salsa undercuts the advances in working conditions Florida
farmworkers have fought to win.*
Chipotle is refusing to sign the Fair Food Agreement with the Coalition of
Immokalee Workers, a group of farmworkers who've successfully convinced
major corporations like Burger King and Subway to participate in a program
that helps ensure that tomato pickers are treated well and paid fairly for
their work.
Send a message to Chipotle's CEO Steve Ells, calling for him to commit to
real "food with integrity" by signing the Fair Food

And it actually gets worse. Chipotle is misleading its customers by
trumpeting the work of the CIW on its website. In reality, *Chipotle broke
off talks with the CIW, opting instead to go it alone* -- no partnership,
no verification, no commitment for the long term. By refusing to partner
with the CIW, Chipotle is undercutting the life-changing work the CIW has
done to protect farmworkers from the often-brutal conditions workers face
at farms not participating in the Fair Food Program.
Since organizing in the mid-90s, the Coalition of Immokalee Workers has
successfully pressured large corporations like Aramak, Compass Group, and
Whole Foods to sign its Fair Food Agreement, guaranteeing a fair wage and
worker protections to the men and women who pick tomatoes across Florida.
And *just this past February, SumOfUs.org members helped convince Trader
Joe's to sign the Fair Food Agreement!*

Like many corporations before it, Chipotle has offered a number of excuses,
many demonstrably false or misleading, and has attempted to circumvent the
CIW with its own, half-hearted plan. They have said, essentially, "Trust
us, we're doing it right". But without signing the agreement, Chipotle has
no way of knowing if the growers they're purchasing from meet CIW's
standards. In fact, a recent audit by the Fair Food Standards Council
revealed Chipotle was paying a smaller premium than it should have been.
*Why does this matter for Immokalee farm workers?*
The Immokalee farm workers, a coalition of people who work on farms in the
Immokalee region of Florida (where most of the tomatoes are grown in the
US) are organizing because they are some of the lowest paid workers in the
country, often making less than $12,000 a year. They work ten-hour days
picking tomatoes in order to pick enough (nearly 2.5 tons per day) to make
minimum wage. They have no rights to collective bargaining or overtime pay.
Each penny a pound increase that they have won brings more people out of
poverty, and each buyer requiring workplace protections ensures more people
are treated fairly in their jobs and fewer farm workers are subjected to
slave-like conditions.
